3. Information we collect and how we collect it
We understand that one of the primary benefits of using Builders Patch is the functionality, features, and convenience our users receive for managing, underwriting, and obtaining analytics on their real estate development projects and facilitating asset management. As such, we also acknowledge that this entails sharing proprietary, sensitive, or non-public information with us that may also include information on your own partners, vendors, customers, and users. In this regards, the information you share with us will be processed, used, and deleted in accordance with this policy.
We acknowledge and appreciate your trust toward our processes and security procedures. We would like to assure you that the information you share with us will be kept in confidence in accordance with this policy, with a reasonable degree of care, for as long as you are a registered user of Builders Patch and for five years thereafter. We will share your information only with members of our team and third-parties that have a need to know such information to enable us to provide our services to you and that, in turn, are bound by similar confidentiality obligations.
When you download, install, register with, access, or use Builders Patch, we may ask you to provide information (a) by which you may be personally identified, such as name, postal address, email address, or any other personal or personally identifiable information under applicable law (“personal information“), and/or (b) that is about you but individually does not identify you.
This information includes, without limitation:
Information that you provide by filling in forms on Builders Patch. This includes information provided at the time of registering to use or access Builders Patch. We may also ask you for information when you interact with us (such as when responding to notices and announcements from us), and when you report a problem with Builders Patch or otherwise correspond with us;
Records and copies of your correspondence (including email addresses), if you contact us;
Your responses to surveys that we might ask you to complete for research purposes;
Details of transactions you carry out through Builders Patch. You may be required to provide financial information before accessing Builders Patch; however, this financial information will not be accessible to us as purchases and payments will be processed through a third-party payment processor(s); and
Your search queries on Builders Patch.
Information provided for demonstration purposes
Additionally, we understand that when we demonstrate Builders Patch to you for your consideration, you may be sharing with us certain information on any current projects you are working on. Any such information you share (for example, proformas) will be used to create tabs and populate the demo dashboard in order to capture the data that is to be uploaded to Builders Patch. After the files you have shared have been uploaded to the Builders Patch system, you and your team will be granted access to the demo dashboard and your files therein. The demo dashboard can then be tested by you and your team.
In case you decide not to proceed and register with Builders Patch, all information provided by you to us will be erased in accordance with this policy and particularly Section 12 thereof.
4. Automatic information collection and tracking
When you download, install, register with, access, and use Builders Patch, it may use technology to automatically collect:
Usage Details. When you access and use Builders Patch, we may automatically collect certain details of your access to and use of Builders Patch, including traffic data, usage data, location data, logs, and other communication data and the resources that you access and use on or through Builders Patch;
Device Information. We may collect information about your internet connection and computer, tablet, smartphone, mobile device, or any electronic device owned or otherwise controlled by you (“Device”) through which you access Builders Patch, including the Device’s unique device identifier, IP address, operating system, browser type, mobile network information, device (including operating system) language; and
Location Information. Builders Patch may collect real-time information about the location of your Device. You can disable this function in the settings of your Device, but some parts of Builders Patch may then not function properly.
You acknowledge and accept that Builders Patch has certain content, features, functionality and/or services that are based on geolocation, location tracking, and geofencing which may also be collecting information on your use and access of Builders Patch, including information on your surroundings and background. You can disable this function in the settings of your Device, but some parts of Builders Patch may then not function properly.
If you do not want us to collect this information, do not download, install, register with, use or access Builders Patch, or delete it from your Device. Certain features may be opted out of. Note, however, that opting out of Builders Patch’s collection of location information will cause its location-based features to be disabled.
We also may use these technologies to collect information about your activities over time and across third-party websites, apps, or other online services (behavioral tracking).
Information collection and tracking technologies
The technologies we use for automatic information collection may include:
Cookies (or mobile cookies). A cookie is a small file placed on your Device. Like most online services, we and our partners use cookies and similar technologies to provide and personalize Builders Patch, analyze use, and prevent fraud. You can disable cookies in your settings, but some parts of Builders Patch may then not function properly; and
Web Beacons. Parts of Builders Patch and our emails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit us, for example, to count users who have visited those pages or opened an email and for other related Builders Patch statistics (for example, recording the popularity of certain Builders Patch content, features, functionality, and services, and verifying system and server integrity).

We also collect the following data from our partners:
Demographic data (such as to determine the coarse location of your IP address);
Data to fight fraud (such as refund abuse or click fraud);
Data from platforms that Builders Patch runs on (such as to verify payment); and

We do not control these third parties’ tracking technologies or how they may be used. You acknowledge and agree that your access and use of such third party tools may be subject to their respective terms of use and privacy policies.

7.1 To make Builders Patch work
To perform the contract, we process data necessary to:
Create registered user accounts (“Accounts”) and allow you to use Builders Patch, access its contents, features, functionality, and services, and to access or use our Site;
Operate our services;
Verify and confirm payments;
At our discretion, provide and deliver products, services, and any other information you reasonably request;
Send you Builders Patch-related communications, such as when updates are available, and of changes to any products or services we offer or provide through Builders Patch;
Fulfill any other purpose for which you provide the information;
Give you notices about your Account; and
Carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection.
7.2 To make Builders Patch more suitable for our users.
To provide a great application and Site to our users, we have a legitimate interest to collect and process necessary data to:
Update and develop user profiles;
Develop and improve Builders Patch and user experience;
Manage our relationship with you;
Provide features as part of Builders Patch;
Customize the Builders Patch experience according to your interests, such as through storing information about your preferences and recognizing you when you use or access Builders Patch;

Provide you offers in Builders Patch as well as in other websites and services, and by email;

To contractors, vendors, and other third parties we use to support our business and/or with which we integrate or link to deliver you Builders Patch, its content, features, functionality, and services and/or with which you use Builders Patch, and who may access your data and operate under their own respective terms of use and privacy policies. To a buyer, investor, or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Builders Patch, Inc.’s assets or stock, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by Builders Patch, Inc. about the Builders Patch users is among the assets transferred;
To fulfill the purpose for which you provide it;
For any other purpose disclosed by us when you provide the information;

To comply with any court order, law, or legal process, including to respond to any government or regulatory request, including in order to combat fraud and illegal activity;
To enforce our rights arising from any contracts entered into between you and us; and
If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of Builders Patch, Inc., our customers, users, or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction.
9. Data security
Unfortunately, the transmission of information via the internet and mobile platforms is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted through Builders Patch. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures we provide.
10. International data transfers
Builders Patch, the Site, and its services may be accessed globally (despite the geographic restrictions we implement) and your data can therefore be transferred to anywhere in the world. Because different countries may have different data protection laws than the United States (or your own country, if you are using Builders Patch outside of the United States), we take steps to ensure adequate safeguards are in place to protect your data as explained in this privacy policy. Adequate safeguards that our partners may use include standard contractual clauses approved by EU Commission and the Privacy Shield certification in case of transfers in and to the United States.
11. Your rights and options
Opt-out of marketing emails and other direct marketing;
Access the personal data we hold about you. If you request, we will provide you a copy of your personal data in an electronic format; and
Your other rights. You also have the right to correct your data, have your data deleted, object to how we use or share your data, and restrict how we use or share your data. You can withdraw your consent, for example, by turning off GPS location sharing in your Device settings. We will respond to all requests within a reasonable timeframe. If you have an unresolved privacy or data use concern that we have not addressed satisfactorily, please let us know. You may also contact your local data protection authority within the European Economic Area for unresolved complaints.
12. Data retention
We retain your data for as long as your Account is active or you are otherwise accessing and using Builders Patch or as needed to provide you Builders Patch. We will, for example, periodically de-identify unused Accounts, and we regularly review and de-identify unnecessary data. Note that if you ask us to remove your personal data, we will retain your data as necessary for our legitimate business interests, such as to comply with our legal obligations, resolve disputes, and enforce our agreements.
13. Changes to our privacy policy
We may update our privacy policy from time to time. If we make material changes to how we treat your personal information, we will post the new privacy policy on this page, and we may also send a courtesy email to you to the email address we have on file for you, if any.

14. Age limits
We do not knowingly collect or solicit personal data about or direct or target interest-based advertising to anyone under the age of 18 or knowingly allow such persons to use or access Builders Patch.
